Purpose of Grant
The No Child Left Behind (NCLB) Act of 2001 requires that State Education Agencies (SEAs) allocate funds to local education agencies (LEAs) to support Title I districts/schools identified for improvement to meet the progress goals in their Comprehensive Educational Plans and thereby improve student performance. SEAs must also allocate funds to LEAs in order for those agencies and schools to meet the State’s academic content standards and student academic achievement standards (Section 1117). According to 2008-09 New York State performance data, students identified as Limited English Proficient/English Language Learners (LEP/ELL) consistently perform below the all student group in all accountability measures except mathematics. The greatest gaps are found at the secondary level in English Language Arts and in graduation rates.
Eligibility
Title I districts that did not meet the NCLB Title III Annual Measurable Assessment Objectives (AMAOs) as of 2008-2009 for 2, 3 or 4 years, and Title I districts serving 500 or more LEP/ELLs will be eligible for the following allocations:
- $25,000 - Districts identified for Title III Improvement with fewer than 500 LEP/ELLs
- $37,500 - Districts with 500 - 999 LEP/ELLs
- $50,000 - Districts identified for Title III Improvement with 500-999 LEP/ELLs
- $67,500 - Districts with 1000 - 2999 LEP/ELLs
- $75,000 - Districts identified for Title III Improvement with 1000 - 2999 LEP/ELLs
- $87,500 - Districts with 3000 - 4999 LEP/ELLs
- $100,000 - Districts identified for Title III Improvement with 3000 - 4999 LEP/ELLs
- $112,500 - Districts with more than 5000 LEP/ELLs
- $125,000 - Districts identified for Title III Improvement with over 5000 LEP/ELLs

Use of Funds
Funds must be targeted to effectively address the needs of Limited English Proficient/English language learners (LEP/ELLs). Funds should be used to design, support, and implement innovative model programs based on best practices that will assist LEP/ELLs to attain English proficiency, meet State academic and student achievement standards, and ensure equitable access to such programs.
Only Title I districts are eligible for an allocation (see the list of districts and their allocations). LEAs must submit the enclosed application in order to receive funds. Funds must be obligated by August 31, 2010. Funds may not be used to purchase furniture.
The funds must support goals for LEP/ELL improvement outlined in the District's Comprehensive Educational Plan (DCEP) or Title III AMAO Improvement Plan, if applicable. Examples of some of the ways these funds can be used:
- Implement high-quality subject matter instruction and support in students’ native languages;
- Provide a support system for middle and high school of LEP/ELLs students to address the issue of high dropout rate;
- Identify and develop appropriate curricula and instructional methods that meet the content learning and English language development needs of LEP/ELLs;
- Provide extended learning time opportunities that might include after-school, extended week (Saturday school), or extended year (summer school) programs;
- Purchase supplemental instructional materials that will help ELL students to meet challenging grade-appropriate State standards and address their language development needs;
- Purchase supplemental instructional materials for school libraries in students’ native languages to support literacy growth and development in both English and students’ native languages;
- Provide professional development for staff on the education and social needs of LEP/ELLs;
- Create partnerships with local institutions of higher learning that have established Bilingual and English as a Second Language (ESL) programs to work one-on-one with district teachers;
- Design and implement family literacy programs that focus on the development of English literacy, English language, and parent-child reading activities;
- Implement programs that systematically train immigrant parents to advocate for their children in school, monitor homework, monitor coursework, and prepare them for high school graduation and college; and
- Increase high-quality early childhood education opportunities for English language learners.
