Waivers

Title I

 

 

 

 

15% of allocation for a LEA with an allocation of at least $50,000; 100% of allocation for a LEA with an allocation of less than $50,000.

 

 

LEAs can receive 100% of their carryover once every three years by applying for a waiver. See below for more information.
Title II, Part A 100% of allocation.  
Title II, Part D 100% of allocation.  
Title III, Part A 100% of allocation (provided that the LEA had an approved plan in that year).  
Title IV, Part A 25% of allocation. LEAs can receive 100% of their carryover by applying for a waiver. See below for more information.

Title V, Part A

100% of allocation.

 

The amount carried over must be expended by the end of the following year. For example, if a portion of a 2008-09 allocation is carried over into 2009-10, an amount equal to the carryover must be expended by the end of the 2009-10 fiscal year.

LEAs outside of New York City may apply for a waiver to the Title I carryover limit by making a request in writing to the Department's Title I School & Community Services office at 365 EBA, 89 Washington Avenue, Albany, New York 12234.

LEAs in New York City should write to the Department's New York City School Improvement office at 584A, 55 Hanson Place, Brooklyn, New York 11217. NCLB requires that the LEA must be able to demonstrate that the request is reasonable and necessary. 

SPECIAL NOTE FOR TITLE I ARRA:
Due to the high number of waivers anticipated for Title I & Title I ARRA for 2010-11, special procedures will be posted with the 2010-11 Title I Allocations.  LEAs cannot request a waiver for 2010-11 before submitting their final 2009-10 Title I and Title I ARRA budgets to Grants Finance.  For 2009-10, the Title I carryover is based on the sum of both Title I allocations and cannot be calculated until both final budgets are processed. 

Any LEA may apply for a waiver to the Title IV, Part A carryover limit by making a request in writing to the Student Support Services office at 318M EB, 89 Washington Avenue, Albany, New York 12234. LEAs can apply annually for this waiver and must, as required by NCLB, show good cause.
