The New York State Board of Regents (Regents) is obligated by law to conduct ongoing performance reviews of each charter school and, at the conclusion of the school’s charter term, to carry out a summative review of the charter school’s performance based on the Regents-endorsed Charter School Performance Framework for Board of Regents-authorized charter schools. The New York State Education Department Charter School Office (NYSED CSO) serves as staff to the Regents to conduct oversight activities on behalf of and to make recommendations to the Regents pertaining to renewal terms and conditions, as well as non-renewals. To facilitate this process, charter schools that have met the rigorous standards set forth in the Charter School Performance Framework can submit a renewal application for consideration by NYSED CSO and the Board of Regents.

The following two documents, which are the foundation of the Regents Oversight Plan, provide the NYSED CSO with a roadmap of the renewal process applicable to all Regents-authorized charter schools. 

  • In June of 2010, the Regents and NYSED embarked on a new approach to charter school authorizing, resulting in the Charter School Performance Framework PDF document for Regents-authorized charter schools. The Performance Framework, which was updated in November 2015, provides an outline of the quality benchmarks that will be evaluated during the renewal process by addressing three broad areas:
    1. The school’s academic success and ability to operate in an educationally sound manner;
    2. The school’s organizational viability and its ability to operate in a fiscally sound manner; and
    3. The school’s faithfulness to the terms of its charter and adherence to applicable laws and regulations.
  • In 2012, the Regents adopted a Charter School Renewal Policy PDF image, which outlines policy, processes and criteria for the renewal of Regents-authorized charter schools.

Completing the Renewal Application: To be considered for a 2019-2024 renewal charter term, Regents-authorized charter schools are required to submit a complete renewal application to the NYSED CSO via an online portal.   • The school's board of trustees is not required to submit an application for renewal of the charter. Before applying for renewal, the board should carefully consider whether the school has met the criteria for renewal as set forth in the Regent's Oversight Plan, including but not limited to, the Charter School Renewal Policy and the Charter School Performance Framework. If the board does not apply for renewal, the charter will not be renewed, and the school will close on June 30th of the final year of the current charter term.
  • In addition to the review of a renewal application, when making a decision to renew a school, the CSO considers additional evidence, included but not limited to, annual reports, independent financial audits, state testing data, and site visit reports that have been collected throughout the entire charter term.
  • Administering Teacher Surveys:
    In preparation for fall 2018 renewal schools’ site visits, each renewal school is to administer the 2018-2019 NYSED Charter School Office Teacher Survey and provide the CSO with the total number of teachers currently employed at the school. Instructions to administer the survey have been emailed to board chairs and the school leaders.  Survey results provide the CSO with valuable information about the school. Questions about the survey should be emailed to CharterSchools@nysed.gov with the subject line reading: Renewal App: Teacher Survey. Surveys should be completed by June 15, 2018.
