Proposed Amendment of Sections 155.2, 155.12 and 200.2 Relating to Special Education Space Requirements Plans

The New York State Education Department proposes to amend sections 155.2, 155.12 and 200.2 of the Regulations of the Commissioner of Education to (1) repeal the regulations that require development of five-year special education space requirement plans and (2) to add that all school districts and district superintendents of boards of cooperative educational services must consider the needs of students with disabilities for placement in the least restrictive environment and for the stability and continuity of their program placements when making changes to the allocation of space for special education programs. The proposed amendment is necessary to conform the Commissioner’s Regulations to sections 1950 and 2215 as amended by Chapter 57 of the Laws of 2013.
