In developing an IEP, a Committee must consider:

  • results of the most recent evaluation;

  • the student’s strengths;

  • parental concerns for their child’s education;

  • academic, developmental and functional needs; and special considerations.

To “consider” means that the Committee has discussed and documented its recommendations related to these factors. With regard to consideration of the concerns of the parents for enhancing the education of their child, this does not mean that every concern expressed and/or recommendation that the parent offers must be included on the IEP form. However, when identifying the needs of the student, the Committee must include consideration of the parent’s concerns for the education of the student. In documenting this consideration, the IEP could, but is not required to, expressly identify the parent’s concerns. If a parent had no concerns related to his or her child’s disability-related needs or chose not to participate in the IEP development process, the Committee could, but is not required to, also indicate this in the IEP.
