The Regulations of the Commissioner of Education have been amended to conform to IDEA 2004 and the final federal regulations to implement IDEA 2004. The Commissioner’s regulations, which were approved as an emergency action by the Board of Regents at their June 2007 meeting, are effective July 1, 2007.
Since these regulations were revised after the proposed amendment was published
on March 21, 2007, they are subject to a public comment period prior to permanent
adoption. It is anticipated that the proposed amendment will be presented
to the Board of Regents for adoption as a permanent rule at the September 2007
Regents meeting. Therefore, the New York State Education Department, Office
of Vocational and Educational Services for Individuals with Disabilities (VESID)
will be accepting written public comment on the revised proposed regulations
from the date they will be published in the New York State Register until August
17, 2007. We request that public comment regarding the revised
proposed amendments be provided using the Public Comment Submission
Sheet, and submitted to:
