The purpose of this memorandum is to provide additional information relating to the Individuals with Disabilities Education Act (IDEA) requirement for parental consent prior to a local educational agency (LEA) billing Medicaid to pay for individualized education program (IEP) Medicaid reimbursable special education/related services.  This information supplements guidance provided in the memorandum dated June 2008 available at http://www.p12.nysed.gov/specialed/publications/policy/medicaidconsent.htm. Attached are a revised sample consent form and a question and answer document to address questions raised by the field since the June 2008 memorandum was issued.
