Education Law 4402(3)(l) Behavior by a Student Presumed to Have a Disability
(l) In accordance with the regulations of the commissioner and the provisions of subsection (k) of section fourteen hundred fifteen of title twenty of the United States code and the implementing federal regulations, to conduct expedited evaluations under the circumstances specified in such federal law and regulations and to conducts such reviews and make such determinations regarding students presumed to have a disability for discipline purposes as defined in subdivision three of section thirty-two hundred fourteen of this chapter as are required under the federal individuals with disabilities education act and implementing regulations.
