Late Bus Service for Nonpublic Students

The Commissioner of Education has held that public school districts are obligated to provide late-bus service to nonpublic schools where such service is provided to the public schools, for pupils "in like circumstances". The Commissioner has also held that a school district is not required to provide late-bus service for individual students or for unreasonably small groups of students, since Section 3635 of the Education Law imposes upon boards of education the responsibility of providing transportation in a reasonable and economical manner. Therefore, a board of education may adopt a policy of providing late-bus service only where there are a reasonable number of pupils for whom the service is requested.
