Pickup Points Must Be Reasonably Safe

  • The Commissioner of Education and the Court of Appeals have acknowledged that all roadside pickup points are hazardous to some degree and that no such location can be absolutely safe.
  • Where establishing pickup points, a board of education may balance considerations of safety, convenience, efficiency, and cost. Pickup points must be reasonably safe, considering the local conditions and alternate bus stops, and taking into account the overall efficiency and cost factors. Nevertheless, it would be an abuse of discretion for a board of education to ignore or fail to give proper weight to the safety of a proposed pickup point.
